Any such claims or disputes shall be resolved in accordance with the laws of Ireland.

The information contained in this website is provided for information purposes only and is directed at persons resident in Ireland only. It is not to be regarded as an offer to buy or sell or a solicitation to buy or sell investments or advice or recommendations to buy or sell investments in any jurisdiction other than Ireland. Ireland State Savings Webchat service

To commence a Webchat users are required to provide their name and agree to the name being processed by Ireland State Savings for chat support. For your own security, you should never disclose personal or account information when using the Webchat service and our representatives will never ask for this information during a chat session with you. Please do not use the Webchat service to send any abusive, defamatory, or inappropriate language during a chat session. No warranty is given by Ireland State Savings as to the availability of the Webchat service. 

Prohibited use of Website

The information on this Website is not intended to be provided to and should not be used in any State or jurisdiction of any nature in which access to or use of such information is prohibited, whether in the format in which it is presented on this Website or otherwise.  If you have any doubts about the legality of your use of this Website, you should not continue any further.

Please note that the NTMA cannot guarantee the privacy or confidentiality of information relating to you that passes over the Internet.  No data transmission over the internet can be guaranteed as totally secure.  Whilst we strive to protect such information we do not warrant and cannot ensure the security of any information which you transmit to us.  Accordingly, any information which you transmit to us is transmitted at your own risk. In accessing this Website and in availing of any of the services/information available on or via this Website, you are deemed by these Terms and Conditions of Use.  Please note that the sending of personal information via email over the internet may not be secure and can be intercepted by third parties or incorrectly delivered.  You should not divulge confidential or personal information over the internet unless you are using secure or encrypted communications technology.

Data Protection/ Privacy Policy

The NTMA will use your personal data in the manner set out in its Data Protection Notice. However, in the event of a conflict between the Data Protection Notice and these Terms and Conditions of Use, the Terms and Conditions of Use shall prevail.

The NTMA respects your right to privacy and complies with the obligations under the EU General Data Protection Regulation (GDPR), and the European Communities (Electronic Communications Networks and Services) (Data Protection and Privacy) Regulations 2003. The Data Protection Notice provides information about the personal information that the NTMA collects and the ways in which the NTMA uses and protects your personal data.

General

If any provision in these Terms and Conditions of Use is held to be unenforceable or invalid, such provision shall be severed and the remaining provisions of these Terms and Conditions of Use shall be enforceable to the fullest extent permitted by the laws of Ireland. 

No waiver of any term of these Terms and Conditions of Use shall be deemed a further or continuing waiver of such term or any other term.

Headings in these Terms and Conditions of Use are for convenience only and shall not be used to construe or determine the meaning of any or all of these Terms and Conditions of Use.

Ireland State Savings Online Terms & Conditions

Definitions

Agreement means these Conditions and any other documents referenced herein that form part of the agreement concluded between us and you for the purpose of availing of the Service.

An Post means An Post acting as an agent for Ireland State Savings on behalf of the NTMA.

Conditions means these terms and conditions for Ireland State Savings Online.

Business Day means a day (other than a Saturday, Sunday or public holiday) on which commercial banks are open for business in Ireland.

Electronic Device means a computing device (including a mobile device) capable of accessing the Service including but not limited to such devices as are wearable.

Existing Ireland State Savings Customer means a person who has purchased a Product - other than a Statement Based or Book Based Deposit Account - after 5th October 2014, or who has a Ireland State Savings Customer Number (SSCN).

Holding(s) means Products held by a Registered User, accessible when using the Service.

Holding Value means the value of a Holding.

Instruction has the meaning given to it in Condition 3.1.1.

Login Details means the personalised security features detailed in Condition 2.2 required to enable each User to access the Service. 

Prize Bond Company means The Prize Bond Company DAC acting as an agent for Ireland State Savings on behalf of the NTMA.

Products means, all products sold by Ireland State Savings with the exception of Statement Based or Book Based Deposit Accounts and any other Ireland State Savings Products issued from time to time by the by the Minister for Finance acting through the NTMA “each a Product”.

Product Conditions means the terms and conditions that apply to a Product.

Registered User means a person who has registered to use the Service.

Registration Process means the process which must be fully completed by a prospective user applying to use the Service, which includes the creation of Login Details.

State Savings Customer Number (SSCN) means your unique Customer Number that identifies you with Ireland State Savings and enables you to transact with us easily.

Service means Ireland State Savings Online.

SMS Message means a message sent using a short message service to mobile devices that use global system for mobile (GSM) communication.

Ireland State Savings is the brand name used by the National Treasury Management Agency (NTMA) to describe the range of savings products offered by the Minister for Finance, acting through the NTMA, to personal savers.

Ireland State Savings Online means the internet service provided by Ireland State Savings for the purposes of managing your Holdings.

User means a prospective user applying to use the Service or a Registered User.

Website means www.statesavings.ie  

Any reference in these Conditions to ‘you’ and ‘your’ includes any User and/or Account Holder and where appropriate includes any Joint Account Holder.

Any reference to ‘We’, ‘Us’, ‘Our’ means Ireland State Savings and or where the context permits or requires An Post and or the Prize Bond Company.

Use of the Ireland State Savings Online service

1. Interpretation

1.1. These Service Conditions set out the terms and conditions of use of the Service and are supplemental to and should be read in conjunction with the Product Conditions Should there be a conflict between these Service Conditions and any of the Product Conditions these Service Conditions shall prevail. 
1.2. In particular, and without prejudice to Condition 1.1 above, the Product Conditions contain information and provisions relating to:
1.2.1. the information and Unique Identifiers you must give us in order for a payment to be properly executed;
1.2.2. execution timeframes;
1.2.3. liability in respect of unauthorised, non-executed, incorrectly and/or late executed authorisations;
1.2.4. interest and exchange rates; and
1.2.5. the manner in and frequency with which we have to communicate with you.
1.3. In these Conditions where the context so allows, reference to any gender includes all genders and the singular includes the plural and vice versa.
1.4. In these Conditions any reference to any statute, statutory provision or to any order or regulation shall be construed as a reference to that statute, provision, order or regulation as extended, modified, amended, replaced or re-enacted from time to time and all statutory instruments, regulations and orders from time to time made thereunder or deriving validity therefrom.
1.5. In these Conditions headings are for convenience only and are not to be taken into account when interpreting these Conditions.
1.6. These Conditions and certain other documents that constitute the Agreement are also online at www.statesavings.ie.
1.7. When you use the Service or any element thereof you are deemed to have accepted these Conditions.

2. Registering for the Service

2.1. To register for the Service, you need to (a) be an existing Ireland State Savings Customer and (b) you must be at least 18 years of age. We may ask to see evidence of who you are, your age and your address and any other evidence which we deem relevant including   evidence of ownership of Ireland State Savings Products. 
2.2. When registering to use the Service you will be required to create Login Details by (a) providing your email address (b) providing your mobile telephone number and (c) selecting a password, and by providing such other details as we may require from time to time as part of the Registration Process. These details may include but are not limited to the following: a personal identification number (PIN), one time passcode, or any combination of these features or other features that we may require now or in future. 
2.3. By registering for the Service, you are agreeing to your information being passed to relevant agencies for this purpose. When we perform electronic checks, personal information provided by you may be disclosed to other parties who may keep a record of that information.

3. Availability and Security

3.1. The Service must be used by you strictly in accordance with the Agreement.
3.1.1. You acknowledge that by entering into this Agreement that you irrevocably authorise us to act on all instructions received in respect of the Service howsoever received which have been or appear to us to have been issued by you without taking any further steps to authenticate such instructions (an Instruction).
3.1.2. You must not disclose any Login Details whether directly or indirectly, to any third party. If you consent to a third party using your Login Details to access your Holdings by using the Service, we will not be liable for any loss you suffer as a result.
3.1.3. Should you know or think it possible that your Login Details have become compromised or known to another person you must notify us without delay and immediately change your Login Details. 
3.1.4. You must disconnect and exit the Service when not using the Service.
3.1.5. You should disable any function on the Service that could allow another person to access your Login Details and/or your Holdings.
3.1.6. You must keep all Electronic Devices secured and before you replace or dispose of an Electronic Device, you must ensure that the Service cannot be accessed using that Electronic Device.
3.1.7. You should check the transactions recorded on the Service on a regular basis. If you believe there has been a mistake or an unauthorised transaction has been made, please contact us as soon as possible on our customer services helpline (our contact details are set out in the “Contacting us” section of these Conditions).
3.1.8. While we will make reasonable efforts to provide the Service, we will not be liable for any failure to provide the Service, in part or full, for any reason that is beyond our reasonable control. This includes, in particular, any suspension of the Service resulting from maintenance and upgrades to our systems or the systems of any party used to provide the Service. 
3.1.9. We may, where we consider it is appropriate for the protection of customers, suspend, withdraw or restrict the use of the Service or any part of the Service. We will inform you as soon as possible if we take such action. We may also end the Service or any part of the Service at any time by giving you reasonable notice. 

4. Our liability to you

4.1. Once an Instruction is received by us with the correct Login Details you agree and acknowledge that we may act on the Instruction and that we will not make any further security checks.
4.2. To the extent permitted by law, and notwithstanding anything to the contrary herein, we shall not be liable for, and shall be indemnified in full by you against, any loss, damage or other liability that you or we may suffer arising out of or in connection with an Instruction or  a transaction made using the Service, unless such loss, damage or liability is caused by our fraud, wilful default or gross negligence or Condition 4.3 below applies. In no circumstances will we be liable for any increased costs or expenses, or for any loss of revenues or anticipated savings or for any special, indirect or consequential damage of any nature whatever.
4.3. If you suffer fraud through the Service, we will refund you the full amount taken fraudulently from your Holdings, provided that:
4.3.1. you have not acted fraudulently;
4.3.2. you have acted fully in accordance with these Conditions (in particular Condition 3.1.3) and your Product Conditions; and
4.3.3. you keep your Electronic Device security software (e.g. anti-virus, anti-spyware and firewall software) up to date and run regular security scans.
4.4. We will have no liability to you for any loss suffered by you where:
4.4.1. we reasonably think you have acted fraudulently and we notify the relevant national authority of this; and/ or
4.4.2. you have fraudulently, intentionally or with gross negligence:
4.4.2.1. failed to keep safe an Electronic Device in accordance with these Conditions or any terms and conditions applicable to it; and/or
4.4.2.2. failed to tell us about the loss, theft of your Electronic Device.
4.4.2.3. failed to keep your Login Details secure. 
4.5. Nothing in this Condition 4 will stop us being responsible for your loss if:
4.5.1. we act fraudulently, with gross negligence or such loss is as a result of our wilful misconduct; or
4.5.2. law or regulation does not allow us to exclude or limit liability.
4.6. We are not liable for any loss or damage arising from any refusal to carry out any Instruction for a repayment from the Service where we are entitled to do so in accordance with these Conditions, the Product Conditions or by law, or for any loss or damage you may suffer as a result of the way in which any such refusal is communicated to you.
4.7. Notwithstanding any other provision in the Conditions, we may take whatever action we consider appropriate to meet our obligations, either in Ireland or elsewhere in the world, relating to the prevention of fraud, money laundering or terrorism and to the provision of financial and other services to persons who may be subject to sanctions. You acknowledge and agree that, to the extent permitted by law, we shall not be liable for any loss, damage or other liability suffered by you or any third party which arises as a result of taking such action.

5. Information on Holding Values and Statements

5.1. You acknowledge that any Holding Values quoted through the Service may not be fully up to date. For instance, the quoted Holding Value may not reflect pending transactions or have been appropriately adjusted to include any debit or credit (whether paper or electronic transactions processed or issued since close of business on the previous Business Day.)  You accept that, as the Holding Value quoted may contain uncleared transactions, it may be adjusted in the event of non-payment of any such transactions. 
5.2. You should carefully examine any Holdings information received by you, or any other information provided by us to you, through the Service from time to time and report any errors or omissions to us via the ‘Add Product’ facility available in the Service. 

6. Charges and Fees

6.1. You are responsible for any third party costs or fees and charges which may apply in relation to the means used by you to access the Service (for example, a mobile phone or internet) or the use of the Service.

7. Termination of the Agreement

7.1. We may end the Agreement on giving two months’ notice to you. However, we may immediately end the Agreement and withdraw the Service without notice:
7.1.1. if you become bankrupt or go into liquidation or if you enter into a voluntary arrangement with your creditors;
7.1.2. if you are no longer, in our opinion, able to manage your financial affairs;
7.1.3. if you die;
7.1.4. if you materially breach this Agreement or any other agreement with us;
7.1.5. if any representation, warranty or statement made by you to us is or becomes untrue in any material respect;
7.1.6. if we must do so in order to comply with any law;
7.1.7. if we reasonably believe that the Service has been used negligently, illegally or fraudulently by you, or by a third party as a result of your negligence or recklessness;
7.1.8. if you use the Service for any unlawful or other inappropriate purposes; or
7.1.9. if for any reason the Agreement becomes unenforceable or void.
7.2. The Agreement does not have a minimum or finite duration and will continue to be binding on the parties until it is terminated.
7.3. You can ask us to end the Agreement at any time by contacting us in accordance with the ‘Contacting us’ section. 
7.4. We reserve the right to process or cancel any transactions in progress on termination of the Agreement or on suspension or withdrawal of the Service. We are not responsible for any loss you may incur as a result of any transaction not being processed as part of the Service after termination of the Agreement or after any suspension or withdrawal of any of the Services.

8. Variation of the Agreement

These Conditions can be amended and or varied in the same manner as the Product Conditions.

9. Notices

9.1. Save where expressly provided, any notice required to be given by you to us in connection with the subject matter of the Agreement shall be given in writing and sent through the post addressed to Ireland State Savings, GPO, FREEPOST, Dublin 1, D01 F5P2.
9.2. Save where expressly provided, any notice required to be given by us to you in connection with this Agreement may be given by any means available to us at the time which is required or permitted by law or regulation, such as a notice provided to you by post, email, through our Website or through the Service, published in a national daily newspaper or displayed in one of the Post Office branches.

10.  Documents Incorporated by Reference

10.1. These Conditions together with any terms, and notices contained on, or which are accessible from the Website, including without limitation, Product Conditions, the Ireland State Savings Website terms and Conditions of Use, the Ireland State Savings Data Protection Notice and the Ireland State Savings Cookie Policy all apply to your use of the Service and constitute the entire Agreement with respect of your access to and use of the Service. 

11. Complaints

11.1. If you feel we have not met your expectations in any way, please let us know so that we can address the problem as quickly as possible.
11.2. If you wish to make a complaint, you can do so by following the Ireland State Savings complaints process which is on the Help and Support section of the Website.

12. Use of Information and Confidentiality

12.1. We process personal information about you in accordance with (a) your Instructions which are provided by you to us when you use the Service; and (b) Ireland State Savings Data Protection Statement which may be viewed at https://www.statesavings.ie/help-support/help-articles/state-savings-data-protection-statement. Please review this document so that you understand how we process your personal information.
12.2. We are entitled to, but not obliged, to record all communications from, or Instructions given by you to us, through our Website.

13. Intellectual Property

13.1. The intellectual property rights in all data, information, systems, processes or other material used by or developed by us for the purposes of providing the Service or performing our obligations under the Agreement shall remain vested, or upon their creation vest, in us or our licensors.
13.2. The copyright and all other rights in any software provided by us and in any user guides or other information provided to you, remains owned by us or by the person who licenses it to us (if applicable). You must use any software provided by us exclusively in connection with this Agreement and for the purpose of receiving the Service as contemplated by the Agreement and as described in any user guide or other information we provide to you. You will obtain no rights, title or interest in any such materials or intellectual property rights relating to them.
13.3. Save where otherwise specified, the intellectual property rights and contents of the Website are owned by us or our licensors. Reproduction of part or all of the contents of the Website in any form is prohibited without our prior consent, other than that you may print or download one copy of the contents of the Website for personal non-commercial use.

14. Temporary Withdrawal of Service

In the event of a breakdown, fault or malfunction of, or connection to, any system used in connection with the Service or where there is a real or potential security risk, we shall be entitled, without incurring any liability to you, to temporarily suspend the Service or access to the Service for such reasonable period as may be required to remedy, address or resolve the system issue.

We shall not be in breach of our obligations under the Agreement, nor liable for any loss, damage or other liability suffered by you or any other person, if there is a delay in, or any total or partial failure of, performance of our duties and obligations occasioned by any act of God, fire, act of government or state, war, act of terrorism, civil commotion, insurrection, embargo, inability to communicate with third parties for whatever reason, failure of any computer  dealing  or  settlement  system or any other computer system, failure of or delay in the transmission of SMS Messages via any mobile phone network or failure of any other telecommunications network, prevention from or hindrance in obtaining any energy or other supplies, labour disputes of whatever nature, late or mistaken payment by  an  agent  or  any acts or omissions of our agents or third parties, or any other reason (whether or not similar in kind to any of the above) beyond our control.

15. Security, Maintenance and Availability

15.1. You accept that electronic communications, the internet, telephone lines or SMS-based telecommunications media may not be secure and communications via such media may be intercepted by unauthorised persons or delivered incorrectly. In consequence we cannot guarantee the privacy or confidentiality of communications via such media although we will put in place security measures to protect these methods of communications.
15.2. From time to time it may be necessary or desirable for security reasons, maintenance, upgrades or other reasons to:
15.2.1. make the Service unavailable to you; and/or
15.2.2. delay implementation of any new functionality; and/or
15.2.3. withdraw, replace or reissue any authorisation process; and/or
15.2.4. change authentication procedures or processes for accessing the Service and while we will use reasonable endeavours to minimise any inconvenience caused to you, you accept that these events may occur and that we have no liability to you in the event of this happening. Where we change authentication procedures for accessing the Service we may introduce these procedures by giving instructions to you via the Service in respect of which such procedures are being introduced.
15.3. You further acknowledge that in respect of certain Holdings we may make some services unavailable to you for particular periods (other than for the reasons outlined in Condition 15.2). Where this is the case, we will endeavour to set out any possible periods of unavailability on the Your Savings screen for that Product.

16. Indemnity

You undertake to us to comply strictly with the Agreement. You acknowledge that your compliance with the Agreement is designed to minimise the risk of unauthorised use of the Service. Except as set out elsewhere within these Conditions, you agree to indemnify us in full in respect of any loss or damages which may arise to Ireland State Savings, you or any third party as a consequence of your non-compliance with the Agreement.

17. Severability

If, at any time, any provision of the Agreement (or any part of a provision of the Agreement) is or becomes illegal, invalid or unenforceable, that shall not affect or impair the legality, validity or enforceability of the remainder of the Agreement (including the remainder of a provision where only part thereof is or has become illegal, invalid or unenforceable).

18. Waiver

Any waiver by us of a breach or default of any of the provisions of the Agreement shall not be construed as a waiver of any succeeding breach of the same or other provisions, nor shall any delay or omission on our part to exercise or avail of any right, power or privilege that we have or may have, operate as a waiver of any breach or default by you.

21. Electronic information

For the Registration Process(es) and where you apply for or access to the Service you agree and consent that:
21.1. any related documents and/or information may be provided in electronic form;
21.2. any related documents and/or information may be retained, presented and produced by Ireland State Savings in electronic form whether originally provided in electronic form or otherwise;
21.3. when asked to do so by Ireland State Savings, you will print, save or download any documents provided in electronic form by Ireland State Savings.

22. Governing Law

This Agreement is governed by the laws of Ireland and is subject to the exclusive jurisdiction of the courts of Ireland.
